Use of Alcohol:

            12oz of Beer = 1.5 oz of "spirits" = 5 oz of wine

            3 things that have a big impact on alcohol effects:

Miscibility (play /ˈmɪsəbəlɪti/) is the property of liquids to mix in all proportions, forming a homogeneous solution. In principle, the term applies also to other phases (solids and gases), but the main focus is usually on the solubility of one liquid in another. Alcohol proof is a measure of how much alcohol (ethanol) is contained in an alcoholic beverage. The term was originally used in the United Kingdom and was defined as 7/4 times the alcohol by volume (abv). The UK now uses the abv standard instead of alcohol proof. In the United States, alcoholic proof is defined as twice the percentage of abv. The measurement of alcohol content and the statement of this content on the bottle labels of distilled beverages, also called liquors or spirits, is regulated by law[where?]. Implied Consent Law

When you have a New Jersey License you agree to a breath test following an arrest for a DUI.   Refusal is the same penalties as a .10 BAC.

            I expect you to remember what Mr Brown said about the constitutional implications.

DWI Penalties

            Under Age "No Tolerance" .01 to .08

                        30-90 loss of license

                        15-30 days community service

                        IDRC

 

            1st Offense Alcohol level of .08

                        3 months  year loss of license

                        $4000-$5000 in fines/fees/surcharges

                        Up to 30 days in jail.

            1st Offense Alcohol level of .10 or Drug Related

                        7 to 12 months loss of license

                        $5000-$6000 in fines/fees/surcharges

                        30 days in jail.

                        IDRC (Intoxicated Driver Resource Center)

            2nd Offense Alcohol or Drug Related

                        2 year loss of license

                        $6000-$7000 in fines/fees/surcharges

                        Up to 90 days in jail  (48 hours mandatory)

                        30 days community service

                        IDRC

            3rd Offense Alcohol or Drug Related

                        10 year loss of license

                        $5500 in fines/fees/surcharges

                        180 days in jail

                        90 days community service

                        IDRC

Is it Murder?

            First Degree - Deliberate.  Deprived indifference to human life.

                        Typical penalty - 25 years to life.

            Secord Degree - manslaughter.  Did not mean it.  Accidental.

                        Typical penalty - Probation to 15 years
